Terms and Conditions

1. Introduction

Thank you for using the Avid Dev Platform ("the Platform") and the features, products, and services ("the Service") we make available on it. Please read these Terms and Conditions ("Terms") carefully as they govern your use of the Platform, including our website and any software application currently developed or that will be developed in the future, as well as any content made available on the Platform.

By signing up to, registering for, subscribing to, accessing, browsing, uploading to, downloading from, or using any of the content that we offer, you acknowledge that you have read, understood, and agree to be bound by these terms of service.

If you do not understand these terms of service or any part of them, you must not use the Avid Dev Platform or access any part of it.

2. Service Provider

These terms are between the user ("You" "Your") and Avid Dev ("Avid," "We," "Us," "Our"), a subsidiary of Quilltools Ltd, a limited liability company.

3. Description of Service

Avid Dev is an AI-powered mobile app generation platform that allows users to create, modify, and generate Flutter applications using artificial intelligence. Key features include:

  • AI-powered Flutter code generation from natural language prompts
  • Real-time mobile app preview capabilities
  • Code sharing features

4. Your Use of Our Platform

You may need to create an account with Us to use all or part of the Platform and Service we provide. Your username and password are for personal use only and should be kept confidential. You understand that you are responsible for all use (including any unauthorized use) of your username and password. Notify us immediately if your username or password is lost or stolen or if you believe there has been unauthorized access to your account. We may reclaim or require you to change your username or password for any reason.

5. Use of the Service

You agree to use the Platform solely for its intended purpose, including:

  • Generating mobile app code using AI assistance
  • Creating and managing mobile app development projects
  • Sharing and collaborating on code projects
  • Testing and previewing generated applications

Any unauthorized use, including commercial exploitation outside of the provided features, reverse engineering of our AI agents, or attempts to extract proprietary algorithms is prohibited.

6. Intellectual Property

All of Avid Dev's trademarks, service marks, trade names, logos, domain names, AI agents, algorithms, and any other features of Avid Dev's brand ("Avid Dev's Intellectual Property") are the sole property of Avid Dev and Quilltools Ltd. These Terms do not grant you any rights to use any of Avid Dev's Intellectual Property, whether for commercial or non-commercial use.

Code generated through our platform remains your intellectual property, subject to any open-source licenses that may apply to generated components or dependencies.

7. Restrictions and Warranties

We aim to create a platform where everyone can access and engage with AI-powered development tools safely and effectively. By using the platform, you warrant that:

  • You will not use the Platform for any illegal purpose or in violation of any laws
  • You will not attempt to reverse engineer, decompile, or extract our AI agents
  • You will not use the Platform to generate malicious, harmful, or illegal code
  • You will not impersonate or attempt to impersonate any person or entity
  • You will not access accounts of others without permission
  • You will not use automated means to access the Platform beyond normal usage
  • You will not use any portion of generated content to train competing AI agents
  • You will respect rate limits and usage quotas

8. Privacy and Data Protection

Avid Dev respects your privacy and complies with applicable data protection laws, including but not limited to Kenya's Data Protection Act, 2019, and the European Union's General Data Protection Regulations. Personal data collected through the platform will be processed according to Avid Dev's Privacy Policy.

9. AI-Generated Content

While our AI strives to generate high-quality, functional code, we cannot guarantee that all generated code will be error-free, secure, or suitable for production use. You are responsible for:

  • Testing and validating all generated code
  • Ensuring compliance with applicable laws and regulations
  • Implementing appropriate security measures
  • Respecting third-party licenses and intellectual property

10. Limitation of Liability

While Avid Dev will do its best to ensure that the Service is of good quality, we do not guarantee that the Service will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, Avid Dev, Quilltools Ltd, and their respective directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform.

11. Indemnification

You agree to indemnify and hold Us harmless from any claims, losses, damages, or liabilities arising out of Your use or misuse of the Platform, any violation by You of these Terms, or any code generated through our Service.

12. Termination

Avid Dev reserves the right to suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or engage in prohibited activity.

13. Changes to the Terms

Avid Dev may update these Terms from time to time. Significant changes will be communicated to users via email or through the platform. Continued use of the Service after changes indicates acceptance of the new Terms.

14. Governing Law

These Terms shall be governed and construed in accordance with the Laws of Kenya.

15. Dispute Resolution

In the event of any dispute, the Parties shall first attempt to reach an amicable resolution through good faith negotiations. If unsuccessful within fourteen (14) days, the dispute shall be referred to arbitration in Nairobi in accordance with the Rules of Arbitration of the Chartered Institute of Arbitrators and the Arbitration Act 1995.

16. Entire Agreement

These Terms constitute the entire agreement between you and Avid Dev regarding the use of our Platform and supersede any prior agreements.
